ANC to Appeal Electoral Court Ruling Over 181 Excluded Candidates in November Elections

PRETORIA, Gauteng — The African National Congress (ANC) is preparing to appeal the recent Electoral Court ruling that upheld the Independent Electoral Commission’s (IEC) decision to exclude 181 of its candidates from the November 4 ballot. The ongoing legal battle, sparked by what the party describes as “technical glitches” during the candidate submission process, has raised significant concerns about the organization’s electoral readiness and internal coordination.

According to Dr. Levy Ndou, a political analyst at Tshwane University of Technology, the court’s dismissal of the ANC’s initial appeal represents a massive setback for the party. He noted that the exclusion effectively wipes out the ANC’s dominance in several key wards and municipalities, compounding the electoral challenges the party already faced in previous general elections.

“It is a huge blow,” Dr. Ndou explained. “It speaks to a party that is disorganized. If you are a major political entity that has participated in all elections since the inception of democracy in this country, you should know better and find ways to avoid a situation where your representatives are not on the ballot.”

The fallout from the exclusion extends far beyond the party’s upper echelons. Dr. Ndou highlighted that the ruling devastates the livelihoods of candidates who have chosen politics as a career, demoralizes grassroots volunteers who have been working tirelessly to galvanize local support, and disenfranchises voters who intended to cast their ballots for the ANC but now find the party absent from their ballot.

The affected regions span multiple provinces. Municipalities impacted by the candidate exclusion include Port St. Johns, Sunday’s River Valley, and Walter Sisulu in the Eastern Cape; a local municipality in KwaZulu-Natal; and Mangaung, the sole metropolitan municipality in the Free State.

With the ANC currently unable to field its own candidates in these specific areas, questions remain about the party’s immediate campaign strategy. Dr. Ndou suggested this scenario could serve as a critical test for the ANC’s alliance partnerships. The party may opt to actively support its alliance partners’ candidates in these regions. This approach could provide those partners with valuable governance experience, while simultaneously allowing ANC cadres in those areas to focus on rebuilding and strengthening party structures without the immediate obligations of governing.

Internally, the administrative blunder has reportedly intensified scrutiny on the ANC’s Secretary-General. Recent media reports have suggested mounting pressure for the Secretary-General to appear before the party’s disciplinary committee over the oversight. While Dr. Ndou acknowledged that the machinery and implementation of party programs fall squarely under the Secretary-General’s office, he emphasized that the collective ANC leadership must ultimately take responsibility for such unprecedented administrative failures.

Meanwhile, the IEC has welcomed the Electoral Court’s decision, noting that it brings much-needed certainty to the official election calendar. The commission has consistently maintained that its submission deadlines are strict, transparent, and clearly communicated to all political parties well in advance. By upholding the rules of the electoral process, the IEC aims to preserve its institutional credibility and ensure the delivery of free and fair elections, regardless of the internal administrative challenges faced by individual political parties.
