JOHANNESBURG - Have you ever wondered how the rights guaranteed by our Constitution are put into practice? And where you can turn when those rights are threatened or violated?
South Africa’s Constitution established independent institutions to help make those rights a reality.
Known as Chapter 9 institutions, these bodies play a vital role in protecting human rights, holding those in power accountable and strengthening our democracy. They are designed to operate independently and serve the Constitution, rather than political parties or the government of the day.
So, how do they help you?
If you believe a government department has acted improperly, you can approach the Public Protector to investigate certain forms of improper conduct in public administration.
If you believe your human rights have been violated, the South African Human Rights Commission can help investigate complaints and promote the protection of those rights.
The Electoral Commission is responsible for managing elections and helping ensure they are free and fair, while the Auditor-General audits government departments and other public institutions to promote accountability in the use of public funds.
Other Chapter 9 institutions work to advance gender equality and protect and promote the rights of South Africa’s diverse cultural, religious and linguistic communities.
Together, these institutions help ensure that public power is exercised within the law and that the rights of all South Africans are respected.
Because democracy is about more than electing leaders. It is also about accountability, protecting our rights and knowing where to turn when something goes wrong.
The Constitution gives us our rights. Chapter 9 institutions help protect them.
