Morocco’s Public Prosecution has ordered prosecutors nationwide to investigate election complaints quickly, maintain continuous duty coverage and coordinate with security services during the September 23 parliamentary election.
The directive, sent to prosecutors at appeal and first-instance courts, calls for firm action against conduct that could undermine the integrity of the vote or distort competition among candidates.
Prosecutors were instructed to activate criminal provisions covering election offenses and refer suspected offenders to court. The circular did not identify specific violations or disclose any cases already under investigation.
Regional and local prosecution units must coordinate with a central cell established at the Presidency of the Public Prosecution and with security teams assigned to election-related cases. Prosecutors must also report any obstacles encountered while implementing the instructions.
The measures cover all stages of the electoral process, including the period before the campaign, campaigning, voting and the handling of related complaints. Continuous staffing is intended to allow authorities to respond to alleged violations without waiting for regular court hours.
The directive describes the judiciary as a central safeguard for public confidence in elections. Article 11 of Morocco’s Constitution states that free, fair and transparent elections form the basis of democratic representation.
The instructions build on enforcement arrangements already used during previous elections. In June, the Public Prosecution issued a separate circular concerning offenses linked to voter registration, an early stage of preparations for the 2026 vote.
Moroccan authorities have also created central, regional and provincial committees bringing together the Interior Ministry and the Public Prosecution to monitor suspected electoral violations and initiate investigations when warranted.
The directive requires senior prosecutors to circulate the instructions among all members of the Public Prosecution service. Its effectiveness will depend on how quickly complaints are examined, whether investigations produce prosecutions and whether enforcement is applied consistently across parties and constituencies.
