DBE moves to fix procurement defects in Foundation Phase catalogue

The Department of Basic Education says it is working to correct legal and procurement defects in the new national textbook catalogue for Grades 1 to 3.

The department is also trying to keep the delivery of learning materials on schedule for the start of the 2027 academic year.

Independent legal advice obtained by Basic Education Minister Siviwe Gwarube found that requirements for approving a procurement deviation had not been properly met, according to the department.

Treasury guidance to be sought

The advice warned that spending connected to the catalogue could be classified as irregular expenditure unless the deviation is lawfully authorised.

Department spokesperson Lukhanyo Vangqa said the DBE would approach National Treasury. Provincial education departments remain responsible for procuring and delivering textbooks lawfully.

The development is a follow-up to concerns that the catalogue dispute could delay efforts to improve early-grade literacy. The department says legal compliance and the protection of public funds must be addressed without leaving learners without materials.

No final Treasury decision or revised procurement timetable had been announced at the time of publication.

The catalogue covers learning and teaching materials used during the Foundation Phase, a critical period for literacy and numeracy. Any delay would affect provincial ordering before schools reopen in 2027.

The DBE said its immediate objective was to correct the defects while ensuring that materials reach classrooms on the first day of teaching.
