Missing lawyer: High Court orders Abshir Abdi produced as LSK threatens street

Kenya’s legal profession is mobilising for nationwide demonstrations after the High Court issued urgent orders compelling authorities to produce missing advocate Abshir Ahmedsadak Abdi, as the Law Society warns the government its constitutional obligations are neither optional nor conditional.

The High Court in Nairobi yesterday ordered designated respondents to produce missing advocate Abshir Ahmedsadak Abdi before it, as the Law Society of Kenya threatened street protests if authorities fail to account for his whereabouts and secure his safe return.

Justice Alexander Muasya Mutetithe, sitting at Milimani, certified the habeas corpus application as urgent and directed respondents to appear personally or through appointed counsel, produce any warrants authorising Abdi’s arrest and detention, and show cause why he should not be immediately released. The case, registered as HCCRMISCAPPL/E268/2026, represents one of the most dramatic legal confrontations between Kenya’s bar and state authorities in recent memory.

Senior Counsel Charles Kanjama, President of the Law Society of Kenya, confirmed the Society had joined the proceedings as an interested party, deploying what he described as all available legal and constitutional mechanisms to secure Abdi’s return. The LSK’s formal participation transformed what began as a family matter into a full institutional confrontation between the organised legal profession and the state.

The Society’s warning to authorities was unambiguous. “Our resolve is to demand the immediate release of Advocate Abshir,” the LSK stated, adding that failure to secure his return would trigger a wider mobilisation of lawyers for public demonstrations. “The Society shall escalate, including mobilising members of the legal profession for public demonstrations to demand Advocate Abdi’s immediate and safe return and hold those responsible to account.”

The Directorate of Criminal Investigations has also entered the picture. The LSK confirmed that the DCI has constituted a committee to investigate the circumstances surrounding Abdi’s alleged abduction, identify those involved, and examine the chain of events leading to his disappearance. The Society demanded the investigation be thorough, independent, impartial, and expeditious.

Kanjama raised broader concerns that go well beyond the fate of one advocate. “No advocate should face intimidation, threats or violence on account of discharging their professional duties or participating in the judicial process,” the LSK stated, reminding the government of its obligations under Articles 21, 29, 49, and 51(2) of the Constitution of Kenya.

Abdi’s disappearance has exposed raw anxieties within a profession that considers the rule of law its foundational purpose. When lawyers begin disappearing, the entire architecture of constitutional order is called into question — and Kenya’s legal fraternity has made clear it will not stand quietly by.
