KZN Hawks commander Deena Govender challenges IPID search warrant after devices seized

Ask AI 6minKZN Hawks officer Deenadayalan Govender

A senior KwaZulu-Natal police officer has approached the Durban High Court to have a search and seizure warrant issued against him declared unlawful, claiming that the warrant was based on false information, material inconsistencies and an inadequate assessment by the magistrate who authorised it.

Deenadayalan Govender, the commander of the National Priority Violent Crimes Unit at the Directorate for Priority Crime Investigations (the Hawks), wants the court to set aside a warrant issued on October 1, 2026, which authorised the seizure of his personal and state-issued electronic devices.

The application, filed in the KwaZulu-Natal High Court in Durban on October 23, names Independent Police Investigative Directorate (IPID) officials Len Barnabas John and Phumlani Ngcobo, the magistrate who issued the warrant, the Minister of Police and the national head of IPID as respondents.

Govender’s application comes after his testimoy at the Madlanga Commission of Inquiry, where he says he was called to testify following allegations made against him by John, an IPID official who had previously testified before the commission.

In his founding affidavit, Govender said he appeared before the Madlanga Commission during August 2026 after allegations were made against him by John.

He said he subsequently made applications to testify in camera because he believed the evidence he intended to provide was sensitive and required further investigation.

According to Govender, he was initially summoned to testify in camera on October 14, but the appearance was rescheduled to October 20 because his attorney was unavailable.

He alleged that following his application to testify behind closed doors, there was an intensification of IPID’s activities against him, particularly because some of the additional evidence he intended to give related to the investigative body.

Govender believes the timing of the search and seizure warrant was suspicious and intended to discredit him.

He said the investigation against him and his unit had been registered in April 2023, yet no application to search and seize his electronic devices had been contemplated for more than three years.

He argued that the warrant application only emerged when he sought to testify in camera before the commission.

According to the affidavit, John and Ngcobo arrived at Govender’s workplace at 136 Victoria Embankment in Durban at approximately 9am on October 9.

John allegedly handed him a copy of the search and seizure warrant, together with supporting documents and a copy of his letter of appointment.

Govender said his personal cellphone was seized at his workplace, while Ngcobo took his state-issued laptop and handed it to John, who placed the devices in exhibit bags and sealed them.

The officers then allegedly instructed him to accompany them to his residence.

At his home, John seized another cellphone, which Govender identified as his state-issued device.

He claimed that no receipt describing the seized items was provided, although the officers gave him tear-off portions of the seals placed on the exhibit bags.

Govender also disputed the warrant’s reference to a personal laptop, saying he did not own one.

The search warrant cited suspected offences of five counts of murder, allegedly committed on April 1, 2023, at approximately 12.30pm in Morningside, Durban.

It also referred to alleged conspiracy to commit murder and money laundering between July 2019 and July 8, 2025.

The warrant authorised the search for and seizure of cellular phones and laptops belonging to Govender, including devices issued to him by the Hawks.

It identified his residential premises at Silver Oak Avenue, Salta Sibaya Estate, Umdloti Beach, as one of the locations covered by the warrant.

However, Govender argued that the affidavit submitted by John in support of the warrant contained serious factual discrepancies that should have alerted the magistrate.

He specifically disputed John’s claim that an interdict had previously been granted against him in favour of Bevan and Gregory Loftus.

Govender said an application for an interdict had indeed been placed on the motion court roll, but no order had ever been granted.

He further argued that no copy of the alleged interdict had been attached to the supporting affidavit.

He also questioned the dates contained in John’s version.

According to Govender, John alleged that the interdict had been granted on March 31, 2024, which was a Sunday.

He said the affidavit also referred to Bevan Loftus being killed on April 1, 2024, while another section referred to a murder docket registered under CAS 41/04/2023, indicating a 2023 registration.

Govender argued that these discrepancies demonstrated that the affidavit contained serious factual inconsistencies.

He contended that the magistrate should have interrogated the information more carefully before authorising the search and seizure.

Govender further argued that applications for search and seizure warrants are brought without the affected person being present, placing an obligation on the applicant to disclose all material facts accurately.

He said the magistrate also had a duty to scrutinise the information presented and protect the constitutional right to privacy.

According to him, the magistrate failed to properly apply her mind to the information supplied by John and effectively acted as a rubber stamp.

He also challenged the wording of the warrant, arguing that it contained several alternatives that had not been deleted to clarify which provisions applied.

Among the alleged defects were references to information being provided under oath or affirmation, alternative descriptions of the suspected commission of offences, and provisions allowing searches during the day and/or night.

Govender argued that the failure to remove irrelevant alternatives rendered the warrant vague, ambiguous and potentially open to abuse.

He further claimed that the warrant did not contain his correct residential address, although he said he would provide the correct address to the judge hearing the matter for security reasons.

In his application, Govender is asking the court to issue a rule nisi calling on the respondents to show cause why the warrant and the searches conducted under it should not be declared unlawful and set aside.

He wants the court to order the immediate return of all seized electronic devices.

He is also seeking an interim order preventing the respondents from disclosing or using any information already accessed from the seized devices as evidence in proceedings involving him while the application is pending.

He wants the first, third and fourth respondents to pay the legal costs of the application on a party-and-party scale.

The application is an account of Govender’s allegations and legal arguments. The court has not, in the documents provided, made findings on the lawfulness of the warrant or the conduct of the IPID officials.
