Boko Haram convict gets 30 years: Inside the charges, confession and arrest

A Federal High Court in Abuja has sentenced Abubakar Goni, a self-confessed member of Boko Haram, to 30 years’ imprisonment for his involvement with the proscribed terrorist organisation, bringing renewed attention to the prosecution of suspected insurgents and the handling of terrorism cases in Nigeria.

Justice Binta Nyako handed down the sentence on Friday after Goni admitted that he knowingly joined the group more than 15 years ago.

According to the report published by Nat ionalDailyNG.com, Goni, who hails from Daira village in Gubi Local Government Area of Yobe State, faced a five-count charge filed by the Federal Government over his alleged involvement in Boko Haram activities.

The charges included membership of the terrorist organisation, receiving training in the use of AK-47 assault rifles, attacks on civilians and looting food belonging to other people to feed members of the group.

He was also accused of participating in attacks on communities in neighbouring Niger Republic before operatives of the Department of State Services (DSS) apprehended him in 2016.

Confession and legal consequences

When the charges were read to him in court, Goni admitted belonging to Boko Haram but denied the other allegations.

His admission paved the way for the court to invoke Section 16(1) of the Terrorism Prevention and Prohibition Act, 2013, in imposing the 30-year prison sentence.

The case highlights the legal consequences of membership of a proscribed terrorist organisation, even where a defendant contests other allegations connected to the group’s activities.

However, the available report does not establish whether the court separately determined the disputed allegations of weapons training, attacks on civilians, looting or cross-border violence.

Defence pleads for leniency

Before sentencing, Goni’s lawyer, Dauda Hassan, urged the court to temper justice with mercy and impose the minimum applicable punishment.

The defence argued that his client had admitted the offence voluntarily and had not wasted the court’s time by contesting the charge of membership.

His status as a first-time offender was also presented as a mitigating factor.

Justice Nyako subsequently ordered that the sentence should run from 2016, when the DSS arrested Goni and placed him in detention. The order means the period already spent in detention is to count towards the 30-year term.

The judge also directed the Federal Ministry of Interior to determine the correctional facility where he would serve his sentence.

Questions surrounding the prosecution

The case illustrates the importance of distinguishing between a defendant’s admission to a specific charge and allegations that remain disputed.

Although Goni acknowledged membership of Boko Haram, he denied the other accusations. The available account does not provide further details of the evidence supporting those allegations or explain whether they were formally resolved through separate findings.

It also does not disclose the specific circumstances of his arrest, the details of the alleged attacks in Niger Republic or whether other suspects were prosecuted in connection with the incidents.

Those details would be necessary to establish a fuller picture of the case and its implications for counterterrorism enforcement across Nigeria’s northeastern region and the wider Lake Chad Basin.

For now, the court’s ruling establishes the 30-year sentence for Goni, with the term commencing from his 2016 arrest, following his admission of membership of the proscribed organisation.
