How Hangwani Maumela Fights to Recover His R70 Million Sandton Mansion From NPA
Controversial businessman Hangwani Morgan Maumela has launched a legal bid to recover his luxurious R70 million Sandton mansion, challenging a final forfeiture order that placed the property among assets seized by the state in connection with allegations surrounding the looting of Tembisa Hospital.
The latest legal move comes three months after the Johannesburg High Court granted the National Prosecuting Authority’s (NPA) Asset Forfeiture Unit a final forfeiture order valued at approximately R325 million against assets linked to Maumela. The order, issued in July, covered several properties, including the upmarket Sandton residence.
According to reports, Maumela’s legal representatives submitted a rescission application last Friday, seeking to have the forfeiture order reconsidered. The application introduces another legal contest over assets that authorities believe are connected to unlawful activities.
The NPA confirmed that it had received the application and indicated that it intended to respond without delay. Spokesperson Kaizer Kganyago told the Sunday Times that the authority would expedite its response and any further processes required to ensure the matter was concluded.
The Sandton mansion had previously been placed under preservation in October last year by the Special Investigating Unit (SIU), a measure intended to prevent the property from being sold, transferred or otherwise disposed of while legal proceedings were underway.
Preservation and forfeiture orders serve different purposes. A preservation order temporarily protects assets while investigations or court proceedings continue, whereas a final forfeiture order allows the state to take ownership of property after satisfying the applicable legal requirements.
The NPA successfully argued in court that the assets were proceeds of unlawful activities allegedly linked to the reported R2 billion looting of Tembisa Hospital. The allegations concern a wider controversy over suspected corruption and the misuse of public funds within the healthcare system.
Tembisa Hospital, a major public healthcare facility in Gauteng, has been at the centre of investigations into alleged procurement irregularities and the diversion of money intended for essential medical services. The scandal has intensified demands for accountability and the recovery of public funds allegedly lost through corruption.
Maumela’s rescission application will require the court to consider the legal grounds advanced by his representatives and determine whether the existing order should be reconsidered. Filing the application does not automatically reverse the forfeiture or restore ownership of the mansion.
The outcome could have significant financial implications, given the value of the properties covered by the forfeiture order. It may also influence the broader legal battle over assets authorities believe are connected to the alleged hospital corruption.
For the NPA, defending the order forms part of its efforts to recover assets allegedly acquired through unlawful activities. For Maumela, the application represents an attempt to challenge a decision with substantial consequences for his property interests.
The court’s eventual ruling will determine whether the forfeiture order remains in force or whether further proceedings are required.
