“I Need A Key To C-Max Cell So I Can Take A Walk” Shadrack Sibiya Says As Bail Hearing Is Postponed

Suspended Deputy National Police Commissioner Shadrack Sibiya reportedly brought a brief moment of humour to his ongoing bail proceedings after asking for the key to his C-Max cell, joking that he wanted to “take a walk”.

Sibiya appeared before the court as arguments in his bail application continued. The senior South African Police Service officer remains in custody while the court considers submissions concerning whether he should be released pending the outcome of his criminal case.

During the proceedings, Sibiya reportedly made the unusual request for access to his cell key, explaining that he wanted to “take a walk”. His comment provided a lighter moment during a hearing that has largely focused on serious allegations and detailed legal arguments.

The case has attracted considerable public attention because of Sibiya’s senior position within the police service and the allegations currently before the court. His defence team has raised questions about parts of the State’s case and the investigation, while prosecutors have continued presenting reasons why his release on bail should be carefully considered.

Evidence relating to the investigation has been placed before the court, including information from police officers involved in the matter. The defence has also scrutinised aspects of the evidence and the manner in which the investigation was conducted.

Sibiya’s lawyers are seeking his release while the criminal proceedings continue. The State, however, is expected to oppose bail by highlighting factors it believes could affect the court’s decision.

In South Africa, courts consider several issues when determining bail, including the seriousness of the allegations, the evidence against an accused, the possibility of interference with witnesses or investigations, public safety and the likelihood of the accused appearing for trial.

Sibiya remains legally presumed innocent unless a court ultimately finds him guilty.

With the bail hearing postponed, he will remain in custody until the proceedings resume. Further legal submissions are expected before the court decides whether he should be granted bail.
