Zambia’s election victory looks clear. What has followed does not sit easily with anyone.

Something strange is unfolding in Zambia. Two weeks ago, millions of Zambians went to the polls to choose a president. A winner was declared, and the margin looked decisive enough to end the conversation there.

It did not. Almost immediately, questions surfaced about what had happened during the count. Independent monitors then released findings that deepened those questions. The opposition said it would go to court. And on the very day it needed to file, the country’s top court was closed.

What began as a disputed election has, in the days since, hardened into a treason case, an election petition that was never heard, and an inauguration going ahead regardless.

On 13 August, Zambians voted between incumbent Hakainde Hichilema, seeking a second term, and opposition candidate Brian Mundubile. The Electoral Commission of Zambia declared Hichilema the winner with 2,965,326 votes against Mundubile’s 1,856,217, a result comfortably clear of any runoff threshold.

While the count was underway, the Christian Churches Monitoring Group ran its own parallel verification, using a statistically representative sample of 1,491 polling stations nationwide. Its conclusion agreed on the essential point: Hichilema had won, with an estimate near 56 percent, still safely clear of a runoff.

On the central question of who won, the independent data and the official tally told the same story. That distinction matters. The evidence available does not support a claim that the outcome was stolen.

It supports a narrower and more uncomfortable question: why did the official margin run five points ahead of the independent one?

CCMG’s own review pointed to around 30 constituencies, out of 226, where official figures appeared inflated against what its observers recorded. Even correcting for those anomalies, the group said, Hichilema’s win held.

Part of the explanation may lie in what happened during tabulation. A day after polling, the Electoral Commission suspended counting nationwide for six hours, citing violence at some centres and reports of stolen ballot boxes. A pause justified by security concerns is not automatically improper.

But European Union election observers reported that once counting resumed, transparency deteriorated. They described a heavier military presence at some tallying centres, fewer opposition agents and citizen observers on the ground, and returning officers who appeared to wait for instructions from Electoral Commission headquarters before announcing results.

Complete polling-station-level results, which would let parties and observers check the figures independently, have still not been published.

Elections are not supposed to run on trust. The strongest response to any question about a vote count is transparency: publish the results, let every party do the arithmetic, and if the numbers hold up, the doubt dies on its own. Zambia has not yet taken that step, and its absence is doing more damage than the original discrepancy.

That unease was compounded by a raid at Mundubile’s Kabulonga residence on 14 August, a day after the vote. Security forces said they recovered rifles and other military equipment. The operation left former Transport and Communications Minister Mutotwe Kafwaya shot dead, and led to the arrest of eleven others, including Bishop Trevor Mwamba, lawyer George Chisanga and businessman Patrick Mwansa, all accused of treason.

Mundubile has maintained that the gathering at his home that day was a party meeting, nothing more.

Against that backdrop, Mundubile’s camp pursued the route the constitution provides: a court challenge, filed within a strict seven-day window that fell on 24 August. When the day arrived, the Constitutional Court complex in Lusaka was cordoned off by police, and judiciary staff were reportedly told not to report for work.

The opposition says it had a petition ready but no way to file it. Authorities cited security concerns, but the timing invites scrutiny of its own. There was a constitutional deadline that could not be extended, and on its final day, access to the one institution that could hear the challenge was restricted.

Other options existed. The court could have offered an alternative filing mechanism. The deadline could have been addressed judicially. Security could have been arranged so the petition still reached a judge. None of that happened.

The window closed, and the Cabinet Office confirmed that with no petition lodged in time, there was no legal barrier to the inauguration. Former diplomat Emmanuel Mwamba wrote to the African Union urging it to intervene before the handover, citing the court closure alongside military deployment at polling stations and a security operation at Mundubile’s residence.

The appeal changed nothing. The petition was never heard, and the inauguration is proceeding as scheduled on 1 September.

What has moved fastest is the case against Mundubile himself. He and running mate Makebi Zulu spent nearly two weeks sheltering at the United Nations Mission in Lusaka, citing fears for their safety, before surrendering to police on 27 August under pressure from the European Union, African Union, SADC, the United Nations, the Commonwealth, Human Rights Watch and philanthropist Mo Ibrahim.

Two days later, lawyer Milner Katolo confirmed that Mundubile and Zulu had been formally charged with treason, one of 18 people now accused in a case that has widened well beyond the original raid. The pair have since been transferred from Lusaka Central Police Station to Mukobeko Maximum Security Prison in Kabwe, a facility reserved for the country’s most serious offenders, without having yet appeared before a court.

There is a bitter irony in this that Zambians have not missed. Hichilema himself was arrested and charged with treason in 2017, under then-president Edgar Lungu, after an incident involving his motorcade and the presidential convoy. He spent months in detention before the charge was dropped, and at the time he argued the justice system was being used against political opposition.

Four years later, he defeated Lungu at the ballot box, and Lungu conceded. Nine years on, the man who once sat where Mundubile sits is the Head of State overseeing a case that, on paper, looks strikingly familiar.

Zambia has earned a particular kind of trust in Africa, and it is worth being precise about what that trust rests on. In 1991, Kenneth Kaunda, who had ruled for 27 years, lost an election and handed power to Frederick Chiluba. Power changed hands again in 2011.

In 2021, Hichilema himself defeated Lungu by a decisive margin, and Lungu conceded rather than contest it. In a region where disputed results have sometimes tipped into violence, coups or constitutional deadlock, Zambia became the country that could point to its own record and say the system works.

Hichilema is a direct product of that system. He ran for the presidency repeatedly and lost, was jailed, and was still allowed to compete again and eventually win. That is precisely why what happens now carries more weight than one election cycle. A democracy is not tested by whether it lets someone in. It is tested by whether it protects the same rules once that person is already in power.

It also helps to understand why the world is watching this particular country so closely. Zambia’s international profile has shifted dramatically. Hillary Clinton’s 2011 visit to Lusaka, the first by a sitting US Secretary of State since Henry Kissinger in 1976, marked a turning point after decades of limited attention.

Since then, senior Chinese officials, Vice President Kamala Harris and President Biden’s joint summit on the Lobito Corridor have all placed Zambia at the centre of a wider contest for influence and critical minerals, copper above all, feeding electric vehicles, artificial intelligence and defence technology. A country with that much strategic and economic weight has less room than most to let political disputes fester unresolved. Every actor watching, from Washington to Beijing, is also watching how this one is handled.

None of the available evidence proves the treason allegations are false, and none of it proves they are fabricated. The government has said the case concerns weapons found at a private residence and a threat it takes seriously; it has not yet laid out that evidence publicly, and 18 people now stand charged without having appeared in court.

Katolo’s own argument is a reasonable one: treason is among the gravest charges a state can bring, and it should not be laid without the State clearly setting out, in court, exactly what conduct it alleges. Governments everywhere take time, sometimes a very long time, to disclose sensitive security material, and that delay alone should not be mistaken for guilt.

But when the delay sits on top of a closed court, an unheard petition and an inauguration proceeding regardless, calling the overall picture unfortunate, and difficult to call fully fair, is a reasonable reading of the facts rather than a partisan one.

Zambia does not need this controversy to have a legitimate president. The independent numbers already put Hichilema above the threshold required to win outright.

Which is what makes the path forward so simple, at least on paper: publish the full polling-station results, let the discrepancies be checked, and let Mundubile and Zulu face a court promptly rather than a prison cell indefinitely. Transparency does not weaken a legitimate victory. It is the only thing that fully secures one.

Across the continent, a generation of younger Africans is already asking harder questions about whether multiparty democracy delivers real change, and every episode where institutions look unable or unwilling to resolve a dispute fairly adds weight to that scepticism.
