The Office of the Director of Public Prosecutions (ODPP) has revealed that Nairobi City County Government, has never forwarded an inquiry file on the construction of the Eastleigh building for prosecutorial review.
In a statement issued on Monday, October 26, 2026, the ODPP said it had not received any file concerning alleged wrongdoing by the developer, construction professionals or county officials involved in the project.
The clarification comes amid growing scrutiny over the building’s construction and questions surrounding the approvals issued by the county government.
According to the ODPP, no inquiry file had been submitted to its office for examination or directions on whether criminal charges should be pursued against any of the parties involved.
“The Director of Public Prosecutions (DPP) wishes to clarify that, as of the date of this statement, no inquiry file relating to the construction of the building has ever been forwarded to the Office by the Nairobi City County Government regarding malfeasance by the private developer, professionals or county government officials for perusal and directions,” the ODPP stated.
The office explained that such a file would enable prosecutors to assess the available evidence and determine whether the allegations disclosed possible criminal offences.
The review would also help establish whether further investigations were necessary or whether the evidence was sufficient to support prosecution against any individuals found culpable.
The absence of the file means the ODPP has not been able to conduct a prosecutorial review of the allegations through the formal process involving the county government.
The statement also places attention on the role of Nairobi City County in documenting and forwarding cases involving suspected irregularities in construction projects.
County authorities are responsible for development approvals and enforcing building regulations within their jurisdiction, while criminal investigations and prosecution follow separate legal procedures.
The ODPP’s clarification does not, on its own, establish whether any wrongdoing occurred during the construction of the Eastleigh building. It confirms that the office had not received the relevant inquiry file from the county government as of Monday.
The next step would depend on whether the relevant authorities investigate the allegations and submit a file for the ODPP to review.
