Fake KCSE, Disability Documents Used in Ksh14.9m Employment Fraud

A former employee of a state-affiliated power generation company has been sentenced to 11 years in prison or forced to pay millions in fines after being convicted of using forged academic and disability documents to secure employment and financial benefits.

The conviction was handed down by the Anti-Corruption Court following a prosecution led by the Office of the Director of Public Prosecutions (ODPP).

“The Director of Public Prosecutions (DPP) has today secured an 11-year prison sentence against a former employee who used a forged academic certificate to secure employment and unlawfully obtained more than Ksh14.9 million in salaries and benefits,” the ODPP stated in a public announcement.

The Scheme and Court Findings

Court proceedings revealed that the convict, David Mogire Nyabuti, presented a forged Kenya Certificate of Secondary Education (KCSE) certificate displaying a mean grade of C-, which allowed him to secure a position as a Craft Grade III employee at Kenya Electricity Generating Company Limited (KenGen).

However, official national records presented in court established that he actually sat his KCSE exams in 1994 at St Paul’s Igonga Secondary School, where he achieved a mean grade of D- across eight subjects.

The convict worked at the state-affiliated company from August 2003 until September 2018. He abruptly resigned after the management requested him to present his original academic certificates for verification. Over his 15-year tenure, he fraudulently earned Ksh14,946,000 in salaries and employment allowances.

Additionally, the court established that he unlawfully obtained a disability certificate from the National Council for Persons with Disabilities, which he used to secure illegal tax exemptions between July 2014 and September 2018.

Penalties and Fines

Delivering the judgment, Senior Principal Magistrate Celesa Okore ordered the convict to reimburse the full amount of stolen public funds:

• Compensation Order: Pay Ksh14.946 million as restitution for fraudulently acquired public funds, with an alternative five-year prison sentence upon default.
• Fraud Fine: Pay Ksh900,000 for acquiring public property through fraud, or serve two years in prison as an alternative sentence.
• Document Forgery Fines: Pay Ksh200,000 for each of two separate counts involving the presentation of false documents.
