Kenya Police puts politicians on notice over strict enforcement of Public Order Act

The National Police Service (NPS) has put political leaders and their supporters on notice over strict enforcement of the Public Order Act as the country nears the electioneering period, warning that violence, incitement and disruption of lawful gatherings will attract firm action.

In a statement, the NPS said it had observed incidents of political intolerance, violence and thuggery in various parts of the country, warning that such conduct undermines public order, threatens national cohesion and infringes on constitutional rights to peaceful association, assembly and political participation.

The service reminded conveners of public meetings or processions that they must notify the regulating officer at least three days and no more than 14 days before the planned event.

The notification should include the organiser’s full names and physical address, the proposed meeting venue or procession route, as well as the date and time. Under the law, the meeting or procession should be held between 6:00 am and 6:00 pm.

The NPS also said that where another event has already been notified for the same date, time and venue, the regulating officer shall promptly inform the organiser.

The event cannot then take place at the originally proposed date, time or venue, although it may be held on a future date subject to the law.

"It is worth appreciating that a notification and subsequent confirmation of all intended meetings by actors across the political divide to the authorised officer serve as a proper and legitimate step in enabling the police to carry out effective and informed security coverage,” the NPS stated.

The Service called on political leaders, supporters and other stakeholders to uphold peace, restraint and the rule of law.

“The NPS once more totally reaffirms that no person, regardless of social status, political affiliation, or public office, is above the law,” the Service added.

The NPS warned that individuals engaging in violence, sponsoring criminal gangs, inciting supporters or disrupting lawful gatherings “will be dealt with firmly and in accordance with the law.”

It further reaffirmed that it remains apolitical and impartial and is committed to serving and protecting the public with competence, professionalism and integrity, while upholding human rights, dignity and accountability.

Kenya’s political transitions are frequently accompanied by heightened rivalries between political factions long before the official campaign period begins.

A recurring feature of Kenyan political rallies is the use of organized youth or hired goons to disrupt competitors' events, heckle opposing speakers, or forcibly secure control over venues.

Political clashes in Kenya have also extended beyond open grounds into places of worship and community centers, where rival politicians or their supporters have disrupted services and gatherings over political turf wars.
