Russell Brand Convicted of Rape and Sexual Assault: What to Expect at Monday’s Sentencing

The courtroom was quiet when the verdicts came in. Russell Brand closed his eyes as the guilty verdict on the rape count was read, but otherwise showed no emotion. On Thursday, 5 November 2026, a London jury ended one of Britain’s most closely watched celebrity trials in years. The comedian, actor and former broadcaster was convicted of rape and three counts of sexual assault.

He will not go home before he is sentenced. Brand will be back at Southwark Crown Court on Monday, 9 November, and he now faces a prison term.

What the jury decided

After deliberating for eight and a half hours, the jury found Brand guilty of one count of rape and three counts of sexual assault. The Metropolitan Police said the verdicts were unanimous. The offences were committed between 2004 and 2009, against four women. They took place in different locations, including a radio station, the set of a DVD recording and Brand’s own home.

The guilty verdicts covered these incidents:

• Grabbing a woman’s breasts at a party in a Soho bar in the summer of 2004.
• Sexually assaulting a woman at the Choice FM radio station in 2004 or 2005.
• Sexually assaulting a woman who testified that he pressed his face into her groin during the recording of an advertisement in 2009.
• Raping a woman at his home in Hampstead in 2009. Reporting describes her as a young fan.

This was not a clean sweep for the prosecution, and it is worth being clear about that. Brand stood trial on seven counts involving six women. He was found not guilty on two other counts of rape and one count of attempted indecent assault.

He was cleared of oral rape and of raping a woman in a Bournemouth hotel room after the Labour Party conference in 1999. He was also cleared of trying to indecently assault an MTV worker after dragging her towards a toilet at her workplace.

The trial and the defence

The case took a long road to court. Brand was first charged in April 2025, and fresh charges involving two new complainants were brought in January, which pushed the trial back to October. Jury selection began on 12 October, and the trial ran for about four weeks.

Prosecutors portrayed him as a predator. One prosecutor accused him of being a ruthless, calculating, manipulative “sexual predator.” The defence leaned on timing. Brand’s lawyers argued that the accusers were undermined by the fact that they went to police years after the alleged assaults, and after a 2023 documentary broadcast anonymous allegations against him.

Brand told the court that “Consent is fundamental, essential, necessary and indeed more important than sex itself.” He denied every allegation throughout. He had also spent time in front of cameras and on social media insisting he was innocent, at one point describing himself as a man changed by religious faith.

Police said his account shifted over time. In four separate interviews he repeatedly claimed he did not recognise the women, and as the trial approached his account changed, which prosecuting counsel called “selective memory.” Before the jury retired, the judge told them that consent was the “million-dollar question.”

What the police say it took

Because the allegations were decades old, there was no CCTV or forensic evidence, and digital enquiries were limited by the passage of time. Detectives had to build the case another way. They traced and spoke to more than 100 witnesses, took more than 400 witness statements and reviewed over 1,400 documents. The investigation began after allegations were reported by Channel 4’s Dispatches, The Times and The Sunday Times in September 2023.

Detective Superintendent Andy Furphy credited the women who came forward. He said the verdict was first and foremost a testament to their courage, and that the conviction sends a clear message that no one is above the law.

What happens at Monday’s sentencing

Judge Mr Justice Bennathan has already signalled where this is heading. He revoked Brand’s bail, saying the rape verdict meant “inevitably a significant custodial sentence.” Here is what to watch on Monday.

The legal range is wide: The maximum sentence for rape is life imprisonment, and the maximum for a single count of sexual assault is 10 years. The Sentencing Council says rape usually draws between four and 19 years in custody. Where Brand lands will depend on how the judge weighs the harm to the victim and his level of responsibility, along with any aggravating or mitigating factors.

Four convictions, one sentence structure: The judge will pass a sentence for each count and decide whether they run together or one after another. The rape conviction will drive the overall length.

Expect a full hearing: Sentencing in a case like this usually includes arguments from both sides, and the court may hear from the victims about how the offences affected them. The judge then explains his reasoning in open court. As a general rule in England and Wales, a conviction like this also brings sex offender registration requirements.

Brand has the right to challenge the outcome, and any appeal would be a separate process after sentencing.

More investigations are under way

The story may not end on Monday. UK police say they are investigating allegations of rape made by two other women, and no charges have been laid. The Met has urged anyone who has not yet spoken to police to come forward.

Brand rose from stand-up in Essex to MTV, BBC radio and Hollywood films such as Get Him to the Greek and Forgetting Sarah Marshall. He was also once married to the American pop star Katy Perry. In recent years he moved away from mainstream entertainment into online commentary and podcasting, and now lives in Florida in the United States. His wife, Laura Gallacher, was at court with him during the trial.
