Ferdinand Waititu will return to prison after the High Court rejected his appeal against conviction and sentence in a corruption case tied to a Sh588.7 million road contract in Kiambu County.
Justice Rose Ougo, sitting at the Milimani Anti-Corruption High Court, dismissed the appeals lodged by the former governor, Luka Mwangi Wahinya and Charles Chege in a judgment delivered on Wednesday, October 14, 2026.
The judge held that the prosecution had established its case beyond reasonable doubt and declined to interfere with the penalties imposed by the lower court.
Waititu and Wahinya, who had been out on bond while their appeals were pending, had those terms cancelled. Justice Ougo directed that both be held at Nairobi Remand Prison.
In a separate turn, the judge set aside the acquittals of the two men, Chege and Waititu’s wife Susan Wangari on money laundering counts. She ordered that all four appear before the Milimani Anti-Corruption Chief Magistrate’s Court for mitigation and sentencing on those charges.
Wangari was to be detained at Lang’ata Women’s Prison until Monday, October 19, when the four are expected in court.
On the fines already imposed, Justice Ougo found no fault. She said penalties issued under the Anti-Corruption and Economic Crimes Act are mandatory and had been lawfully applied.
“The fines imposed by the court under the Anti-Corruption and Economic Crimes Act, being mandatory fines, were properly imposed,” she said.
Waititu was handed 12 years in prison or a fine of Sh52,749,000 in February 2025 after being convicted of conflict of interest and dealing with suspect property. Wangari received one year or a Sh500,000 fine for dealing with suspect property.
Wahinya was sentenced to seven years or a Sh21 million fine for abuse of office. Chege, a director of Testimony Enterprises Limited, the company at the centre of the disputed tender, was given 11 years or a Sh297,048,110 fine. His wife and co-director Beth Wangeci received three years or a Sh1.4 million fine for fraudulent practices and fraudulent acquisition of public property.
All those convicted were also barred from holding elective or appointive public office for 10 years under Section 64 of the Anti-Corruption and Economic Crimes Act.
The case dates back to July 19, 2019, when Waititu and his co-accused were first arraigned on charges including fraud, conflict of interest, dealing with suspect property and money laundering.
