Stanley Eleko: Excise Stamp Burden - Why Nigerian consumers should not pay for regulatory duplication

For millions of Nigerian households, economic hardship is experienced not in the language of fiscal policy but at the market, in supermarkets, at neighbourhood shops and wherever families must decide how to stretch limited incomes.

A small increase in the price of a frequently purchased product can become another difficult choice between competing household needs. That is why a policy designed in the name of tax compliance must be examined not only from the perspective of government revenue, but also through the pocket of the ordinary consumer.

Nigeria’s Excise Stamp Regulations, 2026, introduce a hybrid physical and digital stamp-and-tracking framework for excisable products such as alcohol, tobacco, and sugar-sweetened beverages.

The stated goals of improving traceability, authenticating products and combating illicit trade are understandable. Yet the Manufacturers Association of Nigeria has warned that the associated compliance costs could be passed down the supply chain, raising prices and further straining consumers.

That warning deserves serious consideration because the cost of regulation does not disappear merely because it is imposed on a manufacturer rather than directly on a shopper. Businesses must pay for equipment, technology, implementation, staff training, product handling and any additional processes required to comply. They may absorb some of these expenses, but they may also seek to recover them through prices, reduce other expenditure, cut investment or adjust production.

The precise outcome will vary by company and product. It would therefore be wrong to claim that every stamp-related expense will automatically produce a specific increase in retail prices. But it would be equally irresponsible for policymakers to assume that compulsory compliance has no consumer consequences simply because the fee is not collected directly at the checkout.

Manufacturers have already raised concerns about a difficult operating environment characterised by high energy costs, inadequate power supply, expensive logistics and inflationary pressure. In its September 2025 objection to the proposal, MAN warned that another compliance layer could raise production costs and place additional pressure on consumers.

The issue is not whether government should regulate excisable products. It should. The issue is whether the government has chosen the most economical way to do so.

If the Customs Service already has access to digital records of production and excise operations, and the tax administration has e-invoicing information on commercial transactions, the authorities should establish precisely what additional information the physical stamp contributes.

If it significantly improves product authentication or detection, that benefit should be measured. If the same information can be generated through integrated digital identifiers and existing systems, the case for an additional physical requirement becomes much weaker.

The consumer interest must be part of that assessment from the beginning, rather than an afterthought once prices have adjusted.

A policy may have an admirable intention and still impose a disproportionate burden. Consider a manufacturer required to modify its production line to accommodate a new stamp application process. If the change slows production or requires additional labour, the cost extends beyond the stamp itself. A factory may need to reorganise workflows, hold inventory for longer or adjust distribution schedules.

If implementation is cumbersome, businesses could experience delays and inefficiencies that affect the availability and price of products.

The impact may be particularly difficult for lower-income consumers, who have less room in their budgets to absorb price increases. The burden also extends to retailers and distributors, whose own operating costs may rise if new product-handling or verification procedures are required.

Another concern is the potential effect on consumer choice. When the price gap between legitimate products and cheaper alternatives widens, some buyers may reconsider where they shop and what they purchase. MAN has warned that higher compliance costs could push price-sensitive consumers towards illicit alternatives. That is a risk, not a guaranteed outcome, but one that should be considered carefully in a country where enforcement against smuggling and counterfeit goods remains an important policy challenge.

If illicit products become more attractive because legitimate goods become more expensive, the consequences could undermine the very objectives the stamp system is meant to achieve. Government could find itself imposing additional costs on compliant businesses while illegal operators continue to evade taxes and sell products outside the formal system.

That would be a deeply unfair outcome. Legitimate manufacturers would carry the cost of compliance, consumers would face higher prices, and illicit traders could benefit from the resulting price differential.

The government must also distinguish between a policy that raises revenue on paper and one that improves the overall welfare of the economy.

A new system could increase reported excise collections among compliant businesses while simultaneously raising the cost of compliance, weakening sales or encouraging substitution towards untaxed products. Its overall success cannot be measured by gross collections alone.

A credible evaluation should examine the cost per unit of compliance, retail price movements, changes in production and sales, the proportion of goods found to be illicit, and the net revenue generated after implementation costs are considered. It should also assess whether any price increases are attributable to the stamp system or to other factors, including changes in excise rates, energy costs, exchange rates and distribution expenses.

Without such evidence, both the government and its critics risk making assumptions about the policy’s effects. The answer is not to dismiss industry concerns, but to test them against transparent data.

There are alternatives. Government can strengthen the integration of existing databases, improve risk-based audits, intensify intelligence-led enforcement at borders and within domestic distribution networks, and introduce digital verification tools where they fill demonstrable gaps. These approaches should be compared objectively with the costs and benefits of the hybrid stamp regime.

Where a physical stamp is genuinely necessary for a specific product or high-risk supply chain, the government should explain why, consider targeted application and provide sufficient transition arrangements. A blanket approach should not be adopted without considering whether the same objectives could be achieved more efficiently.

Most importantly, the government should not ask households to shoulder the cost of regulatory duplication. Nigeria’s consumers have no control over how government agencies design their systems, negotiate technology contracts or coordinate their databases. They should not become the default financiers of an inefficient administrative arrangement.

The test of good tax policy is not simply how much government collects, but how efficiently it collects it and what the policy costs the wider economy. If a stamp system adds to household expenses without delivering a demonstrable improvement in enforcement, its social cost could outweigh its public benefit.

The federal government should therefore require an independent consumer-impact assessment and publish clear evidence of the system’s additional value. Where the costs exceed the benefits, the regime should be redesigned or replaced with a more efficient alternative.

Nigerians need a tax administration that protects public revenue without unnecessarily making everyday life more expensive. The government should pursue illicit traders, close enforcement gaps, and collect legitimate taxes—but it must not allow ordinary consumers to pay for a system whose necessity and value remain insufficiently established.
