Stanford’s $149,000 H-1B Filing: What Foreign Workers Should Know

For professionals outside the United States hoping to build a career there, finding an employer willing to sponsor a work visa is often one of the biggest hurdles.

But a recent hiring filing by Stanford University offers a reminder that understanding the H-1B visa system requires more than finding a job with an attractive salary.

A notice filed by Stanford with an intent to hire an H-1B financial analyst at an annual salary of $149,000, has attracted questions about why the university is seeking a foreign worker while California continues to face a difficult employment market.

The filing, highlighted in a post by an investigative journalist on X on October 14, has prompted debate over whether a qualified American could fill the position.

“We are a country of 340+ million. I understand H-1B for talent in the 1%, but there's no way a Senior Financial Analyst cannot be found within our citizens,” one X user wrote, with another user saying, “Why wouldn’t they hire an American who took out tens of thousands of dollars of student loans to pay their outrageous tuition, room, board, and book costs?”

As of August 2026, California's unemployment rate stood at 5.1% in August, with nearly 993,000 people unemployed, according to the US Bureau of Labor Statistics.

But those figures don't establish how many unemployed people have the qualifications and experience Stanford needs. The filing also doesn't, on its own, explain the university's recruitment process or why it's seeking an H-1B worker.

For foreign professionals considering US employment, the distinction matters. An employer advertising or pursuing a role for an H-1B worker doesn't necessarily have to prove that no qualified American exists for every position.

How the H-1B hiring process works

The H-1B programme allows US employers to hire eligible foreign professionals for qualifying jobs. Employers must meet requirements that include paying the required wage and complying with rules designed to protect US workers.

Additional recruitment and non-displacement obligations also apply to H-1B-dependent employers and certain employers found to have committed willful violations. At the same time, some employers can qualify for an exemption from these additional obligations if the worker earns at least $60,000 annually or holds a relevant master's degree or higher.

Stanford's reported $149,000 salary exceeds that wage threshold, but salary alone doesn't establish whether the university qualifies for an exemption or whether its hiring process meets the applicable requirements.

Universities also have a distinct advantage under the programme. Qualifying institutions of higher education can hire eligible H-1B workers without being subject to the annual numerical cap that limits many other employers. They must, however, still comply with the other requirements governing H-1B employment.

This means foreign applicants should not assume that every US employer follows the same route when sponsoring workers. An employer's eligibility, the role and the applicable immigration requirements can all affect the process.

What this means for professionals seeking US jobs

The Stanford filing comes amid increased scrutiny of employers hiring foreign workers.

On October 8, the Trump administration announced the suspension of Microsoft and several other technology companies from a programme that allows employers to sponsor foreign workers for permanent residency.

Vice President JD Vance has also called for investigations into nine universities over alleged abuse of the J-1 exchange visitor programme, including Stanford, Harvard, Yale and MIT. Stanford has said it would cooperate with the investigation.

These developments involve different immigration programmes, so they shouldn't be treated as interchangeable. But they underline why international applicants need to understand which visa route applies to a prospective role and what their employer is required to do.

If you are considering a US job, start by:

• Identifying employers that hire internationally and checking whether a role is open to candidates who require sponsorship.
